Growing evidence makes this clearer by the day: Diversity, equity and inclusion (DEI) does not help American institutions attain progress or profit.
It’s time for all institutions to get back to their basic duties and stop pushing extreme agendas on the American people. This is especially important for American corporations that have a fiduciary obligation to make decisions in the best financial interests of their shareholders.
A growing chorus of Americans recognizes the acute challenges of DEI. Even the co-founder and CEO of a prominent DEI consulting firm laments assuming the role of “moral authority” on the subject and regrets labeling people who disagree with DEI as “bad” people.
The controversy over DEI has also captured the attention of two well-known businessmen, Mark Cuban and Bill Ackman, both of whom have engaged in a tense exchange on X, formerly Twitter.
Cuban, the Dallas Mavericks owner and star of “Shark Tank,” wrote, “Diversity—means you expand the possible pool of candidates as widely as you can. Once you have identified the candidates, you hire the person you believe is the best.”
“That’s exactly what I thought until I did the work,” said Ackman, the founder of Pershing Square Capital Management and Democrat mega-donor. “I encourage you to do the same and revert. DEI is not about diversity, equity or inclusion. Trust me. I fell for the same trap you did.”
In the same post, Ackman explained that DEI is “a political advocacy movement on behalf of certain groups that are deemed oppressed under DEI’s own methodology.”
In simplest terms, what Ackman and others critical of DEI have identified is the inherently flawed nature of the ideology. By insisting that our institutions are irredeemable and cannot escape past wrongs or that people groups should be divided into two camps — oppressed and oppressor — the adherents of DEI are compelled to use the levers of those very same institutions to manipulate outcomes based on identity rather than merit.
This conduct is dangerous when you consider its effects on our economy and our public corporations.
Good business is ultimately about producing a good product, not pushing an agenda. DEI unnecessarily complicates that winning American formula. Rather than focus on improving production and goods, companies are now choosing to divert resources and attention to internal race and identity-based policies that neither improve return on investment to shareholders nor result in better products for consumers.
Corporations adopting policies that prioritize social engineering over corporate responsibility do not serve the interests of all Americans. Instead, they appease the extreme desires of a few, thereby eroding confidence in the ability and competency of our institutions.
It is neither profitable for businesses nor sustainable for the American people.
Along the same lines, those in the financial services industry must understand that fiduciaries must have a single-minded purpose in the returns on their beneficiaries’ investments.
State and federal law have long recognized fiduciary duties for those who manage other people’s money. The Employee Retirement Income Security Act, for example, demands that a fiduciary “discharge that person’s duties with respect to the plan solely in the interests of the participants and beneficiaries, for the exclusive purpose of providing benefits to participants and their beneficiaries …”
As attorney general of Kentucky, I was one of 22 state attorneys general who signed a letter warning financial services companies that they may be violating their fiduciary responsibility to shareholders by agreeing to radical activism in their environmental proposals. I also issued a legal opinion outlining why government-sponsored racial discrimination and so-called “stakeholder capitalism” was unlawful.
We’ve collectively witnessed some of the consequences of extreme ideology taking priority over responsible corporate governance. After Bud Light’s infamous foray into the culture wars, its sales collapsed, forcing one of its executives to step down. We’ve also seen prominent fund managers like Vanguard drop ESG-driven investments — another ideological blunder at the corporate level — because they have not been profitable and have exposed their investors to greater losses.
DEI objectives have moved some of our business so far from their purpose that even those on the left like Ackman are compelled to speak out, underscoring that the adverse reaction to DEI is not a partisan issue.
Most Americans want our corporate institutions to move away from extreme ideologies. It’s time to return to the American formula of producing great products and services, not pushing agendas.
Daniel Cameron is the former attorney general of Kentucky and the current CEO of the 1792 Exchange.

Laws of Illinois, 1961
Continuing my series of learning about things referenced in the book, I'm looking at things Alex references when he talks about engaging with queer history. These are all tagged #a series of learning about things that are referenced in the book, if you want to block the tag.
Tumblr media

When Alex talks about the laws of Illinois, 1961, as far as I can gather he's referring to the sodomy laws which were used across the US in an underhand method to criminalise homosexuality - and in particular Illinois' decision in 1961 to repeal their sodomy law.
Before this, sodomy was as a felony in every state, punished by a long prison sentence or hard labour. The American Law Institute developed a new modernised criminal code, which included the removal of consensual sodomy from the laws prohibiting it. Illinois was the first state to adopt that recommendation, repealing the law against sodomy but adding to their legislation the new crime of "lewd fondling or caress of the body of another person of the same sex" in a public place. While this was amended two years later to say "either sex", the homophobic intent was clear. This focus on ensuring that couples, both heterosexual and homosexual, had the right to privacy in private spaces was enforced again in Illinois, in 1970 with a constitutional amendment. This granted people the right "to be secure in their persons, houses, papers and other possessions against unreasonable searches and seizures, invasions of privacy or interceptions of communications".
Following Illinois' actions, 19 more states repealed their sodomy laws throughout the 1970s. California's repeal took six years of debate and passed in 1975, only after a tie break vote by the Lt. Governor Mervyn M. Dymally. The other states mostly carried out the repeal whilst undertaking a general reform of their criminal laws.
-----
In 1986, the Supreme Court heard Bowers v. Hardwick. This was a challenge to a Georgia law which made sodomy a crime for everyone - not just same-sex couples. Mr Hardwick was arrested after a police officer entered his home with an out-dated warrant for a missed court date. (Hardwick had paid a fine & the issue had been settled three weeks prior.) When the police officer gained access, he discovered Hardwick and another man in bed together, engaging in consensual oral sex. The police officer then arrested both men for sodomy, after Hardwick threatened to have him fired for entering his home without a good reason. The District Attorney decided not to pursue with prosecution as the warrant was invalid as well as his own negative feelings about the sodomy laws being used in such a way. Hardwick then sued the Attorney General of Georgia in an attempt to prove the state's sodomy laws were invalid. After appeals, this made it to the Supreme Court, which rejected his attempt, and upheld the sodomy laws to be valid.
The Bowers case, and specifically the contempt displayed towards gay people in the ruling, became precedent for more discrimination against gay people. The Court argued that it was facetious to argue the fundamental right to privacy protected gay people, and that intimacy between queer couples was entirely unconnected to intimacy between heterosexual couples.
-----
By 2003 ten states still had bans for consensual sodomy, with no specificity regarding hetero- or homosexual encounters, while four states had laws specifically for homosexual couples.
2003 is chosen as a cut off year specifically here, because of a key case that was before the Supreme Court in the first half of 2003, Lawrence v. Texas. In 1998, Lawrence - then 55 - was arrested with his friend Tyron Garner after a false police report of a man with a gun was called in. When officers entered Lawrence's apartment, he was - allegedly - engaging in consensual sex with Garner, violating the Texas sodomy laws. It should be noted that the arresting officer was not known for his honesty, and two of the four officers present didn't report seeing any sex. Lawrence himself denied that they were having sex.
Lambda Legal gay rights advocates seized the opportunity to take the case to the Supreme Court, and attempt to overturn the sodomy laws. In July 2002, attorneys for Lambda Legal asked the Supreme Court to consider three things:
1. Whether the petitioners' criminal convictions under the Texas "Homosexual Conduct" law—which criminalizes sexual intimacy by same-sex couples, but not identical behavior by different-sex couples—violate the Fourteenth Amendment guarantee of equal protection of the laws; 2. Whether the petitioners' criminal convictions for adult consensual sexual intimacy in their home violate their vital interests in liberty and privacy protected by the Due Process Clause of the Fourteenth Amendment; 3. Whether Bowers v. Hardwick should be overruled.
In June, 2003, the Supreme Court issued a 6-3 majority in favour of Lawrence, holding that:
A Texas law classifying consensual, adult homosexual intercourse as illegal sodomy violated the privacy and liberty of adults to engage in private intimate conduct under the 14th Amendment.
In simple words, the sodomy law in Texas was not legal, and the Bowers finding was reversed. Sodomy could not be prosecuted when applied to consenting adults in private.
It was no longer a crime to be gay.
-----
“The core of this opinion is that individuals have the right to choose and define their own intimate, personal relationships,” said R. Bradley Sears, director of UCLA’s Charles R. Williams Project on Sexual Orientation Law. “The connection that was made in the majority opinion is that sodomy doesn’t exist in a vacuum. That conduct exists in the context of gay and lesbian relationships and families.”
"The years have seen the rapid expansion of gay rights, with a state-by-state push for same-sex marriage heading the list. And much of this progress can be traced to Lawrence v. Texas, with its message of tolerance and inclusion in American life." [source]

OC ask for all ur gals, #22-brief history. So that folks can get an intro!
Okay! 22. Give us a (brief, or not) history lesson of your OC(s)
Let me get the uh...the spreadsheet up...
Mercy: Mercy Rose (Bishop) Hamilton, born on 08/02/49 in Florida. She moved to the Boston area after meeting Nathaniel Joseph Hamilton and he finished with his military service. She started out as a defense attorney in a fairly large firm, but left because the partners were a bunch of "jackasses." She started her own firm and would take cases pro-bono to help "the little guy" beat "big old bullies." This tenacity and stubborn streak would aid her well when she woke-up in Vault 111 after Nate was killed and Shaun taken. Despite being a tiny burning torch of rage and grief, she's dedicated herself to finding a way to track down her husband's killers while also forging a home in the Commonwealth and she's not going to let anybody stand in her way to track down her son (pro-tip, she's Highly Disappointed in who and what Shaun became). She eventually falls in love with MacCready, Deacon, and Jake Evans - cobbling together an unorthodox relationship that somehow works - even if Mac never stops bossing people, Jake leaves tools everywhere, and Deacon has the gravitas of a 2 year old.
Sparrow "Emma" Williams: Born 01/03/2269, is 19 when you first meet her. She was born somewhere in Massachusetts, but not in the Boston Commonwealth area. Her parents were farmers on a decently prosperous farm and she was the oldest of three children. When she was 11, slavers attacked the farm. They killed her father, tortured her mother, and ripped her younger brother and sister out of her hands. She got away, but not before she was shot. A neighboring farm took her in as little more than slave labor. She stayed until well enough to travel, moving from farm to farm as she grew older, till she heard of Diamond City. The Great Green Jewel sounded like the best place for an illiterate 14 year old who needed work, so she managed to make her way there. Unfortunately, at 16, the Institute paranoia began to run over into Piper's writings, and Emma - who is so pale she's almost an albino, around 4'9" tall, malnourished, and barely talks - caught the eye of the locals. Convinced she was an Institute plant, they drove her from the city, several men holding her down and branding her so she couldn't Hide The Truth. She fled into the Commonwealth and hid, making do with scavving and living off of what she could steal. When Mercy started setting up settlements, transplants from Diamond City saw her and spread the word that she was Institute. A bounty (that hit 600 caps) for her dead or alive was issued - and Mercy didn't know about it. Fortunately for Emma, she ran into a helping hand - Canary aka Grace Williams. Canary and her partner, Birdie, adopted Emma - who renamed herself Sparrow. She now does work for the Railroad and Mercy. She's dating a synth named Bean and a member of the Railroad, Darcy (Coyote). Francesca "Frankie" Warren is 23 (I haven't gotten her birthdate down yet) and is part of the local band, Cora and the Wailers. The band plays in Annie's Tavern in Jamaica Plains and is one of the biggest draws to the burgeoning town. She grew up near the Dallas/Ft. Worth Crater in Texas, the only child to the High Priest and his Wife of a Fundamentalist Christian Children of Atom cult. The cult believes that Atom is the return of Jesus and true believers will allow themselves to show their belief through division. Frankie was raised to become the wife of her father's second-in-command's oldest - who was only 14 years older than her (blech). When she turned 14, she stole money from the church lockbox and hightailed it West to California where she became a stripper, taught herself to play more than just the banjo and clarinet (she also plays the guitar and trumpet) and joined Cora's band. The band started heading East, hit the Commonwealth, heard about Jamaica Plains - and well, settled in (in the SWAMP as Frankie likes to moan). She's a fiesty 4'10" of blonde hair and big brown eyes that will beat you with a big old stick. She met a "hot" ghoul (she's the first to admit that Beau is one gnarly looking dude - but that man is FIRE) and fell in love...hard. Her and Beau will be heading back West to Texas to rescue her baby sister...that she just found out about when her Daddy showed up to abduct her and drag her back to Texas. Let's just say that Beau's sweet and a gentleman - till you hurt Frankie...and then some of who he used to be comes out to play.

People in Texas:
If you had a child during your same-sex marriage through ART/IVF or through an informal sperm/egg donation agreement, please know that you may not necessarily have guaranteed parental rights over that child under current Texas case law, and legislative action that dissolves your marriage will make gaining parental rights even harder. Act sooner rather than later.
Contact an attorney that's knowledgeable in LGBTQ+ family law and talk to them about whether you or your spouse needs to adopt your child. Second parent adoptions to confirm your parental rights can be done relatively quickly; you won't necessarily need a home study (if you're married, the court can waive it), but you will probably need a background check and a CPS history check, so be prepared for that.
You can file the case in a friendly (liberal) county so you're not exposing yourself to unnecessary prejudice. I work in the DFW area, and I know that Dallas County is friendly. If you know your sperm/egg donor, you may need them to specifically waive their parental rights, but it's literally just one notarized form with two witnesses.
When it's a situation of IVF/ART with an anonymous donor, second parent adoptions are usually relatively straightforward. They do take a few months, due to delays from DPS and CPS, so it's better to start sooner rather than later. Have a copy of your ART/IVF paperwork on file.
I do second parent adoptions regularly in my practice, and my firm doesn't charge a huge retainer; as far as I know, other LGBTQ+ firms in the area also charge low retainers. Feel free to ask the attorney if they'll work with you on the financials.
If you can't find an LGBTQ+ attorney to work with you, either check the National LGBTQ+ Bar's affiliates:
Or, if you are in Texas, message me privately with what county you're in and I'll give you a referral.
Before January 2025:
If you are a USAmerican in a relationship that might be affected by legislation that dissolves same-sex marriages, who may no longer be recognized as next-of-kin, especially if you have children, get your rights in writing!
Your marriage certificate may not be enough to prove you have rights to make medical decisions for non-biological children or for a same-sex spouse or partner.
Go to a lawyer, get it spelled out as clearly as possible that you have a voice in emergency medical and legal situations.

Subject: Gene testing, Crane, Tx Hx and more
Michael Dean Duerksen age 2 was named Mara Silo Parmiese Devereaux by adopted parent surgeon Dr William or Walter Silo Parmiese Devereaux whom is believed to have performed comprehensive sex change surgery and other sex change methods on Michael, and taken to Devereaux Hastings New Orlean's Children's Home.  ....next:  Olympia Genetic Analysis company, Hollywood, California report on Mike D. Duerksen and done 1959 to 1967 and 1972, and the 1967 Crane, Tx..report value shows deviant twisting of his genes using inoriginate genes by Dean F. Duerksen using a gene sauce of non-Salicylic genes acid, which is detrimental to the target, then orange staple gun genes that provide a gunned like effect to genes, then green tea leaf genetic structure to damage or recleuse original genes by showing in part, Rothchild-Duerksen...and Fraley Duerksen Rothchild is an inserted value.  This report went to LAPD officer Gerald Shrimpton, also officer Gene Taylor Talasco ( and other Talascos: Jim, Susan ) and the conclusion was that Dean F. Duerksen was involved in criminal usage of Gene science on Michael Duerksen to alter behavior, murderous use of Gene science to murder personality or to cause the death of Michael Duerksen, then to get Dean past investigators whom are looking into his genetic tampering to hide normal genetic family values of Folgers- Rothchild -Degeneres. Dean used First Amendment Services, but was found guilty and judged by Charles Colman Halderman (?) with 25 harsh spankings and one year in Crane county Detention center which has extension services that allows inmates to go home once per week or so.    Next: 25 to 29 individual Illuminati members adopted Michael Dean Duerksen by McCall.  13 individual members of the Dallas Hilton family adopted Michael Duerksen.  3 to 4 we're Illuminati members. Some were part Italian and part Spanish. In Crane County, Crane, Tx between 1964 June and 1967 June, Crane authorities used disciplinary actions against Roman Polanski and V. Frykowski due to their decisions to do as they pleased since they had the money and didn't think it would matter in that small town of 3,000 or so.  Mike Dean F. Duerksen was not subjected to any disciplinary actions due to his status as a child abuse victim. Harrison and Sorrills, both from Poland and held to be worth a 20 to 40  billion dollars and understood to have made oil company purchases of a total of100 million and various real estate purchases due to the rich nature of the oil and gas discoveries in that county as part of the Permian Basin.  Purchases and investments appear to have included Dennis and Mildred Fisher Oil Company Ltd...   Other adopters of Mike Dean Duerksen appear to include T. D. Eason, a US Magistrate and county judge, giving him the name of Jim Roy Bean Duerksen Eason and Jim Bo Gordon Mangrove Rothchild Eason.  Also Dr. Paul Maynard M.D. a family physician, father of Tim, was an adopter whom was known to target Dean Duerksen with suspicions regarding Maynard's observations of his son Mike as a patient whom appeared to be a victim of Dean's abuse. Then Ken Spencer, attorney and overseer.  A Julia Crane Gantry Nelson was a county attorney.  Harrison and Sorrills had an unsuccessful adoption effort or relationship to Paul Dean Duerksen since they appear to have viewed Paul as a crick in the neck and a ratfink whom followed them around town and reported anything he saw.

Senators call for probe of Thomas amid report of real estate deals with GOP donor
By Amy B Wang
Updated April 14, 2023 at 4:13 p.m. EDT|Published April 14, 2023 at 1:18 p.m. EDT
Associate Supreme Court Justice Clarence Thomas arrives for the swearing-in ceremony of Judge Neil M. Gorsuch as an associate Supreme Court justice in the Rose Garden of the White House in Washington on April 10, 2017. (Joshua Roberts/Reuters)
Democratic lawmakers are calling for an investigation into Supreme Court Justice Clarence Thomas after ProPublica revealed Thursday that he had failed to report real estate deals made with Harlan Crow, a Dallas business executive and influential Republican donor to causes related to the law and judiciary.
According to ProPublica, Crow purchased three properties in Savannah, Ga., from Thomas in 2014, including the single-story house where Thomas’s mother was living and two vacant lots nearby. Thomas did not disclose the $133,363 real estate transaction on his financial disclosure forms, as federal law would have required. Crow told the outlet that he wanted to preserve the first property as a museum dedicated to Thomas in the future, and said he had spent tens of thousands of dollars on improvements to the house “to preserve its long-term viability.”
Thomas has not publicly commented on the latest ProPublica report and neither Thomas nor representatives for the Supreme Court responded to requests for comment Thursday.
The report came on the heels of another ProPublica investigation that revealed that Thomas had accepted trips around the globe from Crow for more than two decades, including travel on a superyacht and private jet, without disclosing them. Thomas said last week that he had been advised “by colleagues and others in the judiciary” that those luxury trips counted as “personal hospitality” that did not have to be disclosed.
The first report prompted Senate Democrats to publicly urge Chief Justice John G. Roberts Jr. to start his own investigation into gifts to Thomas from Crow, and reinvigorated calls for the Supreme Court to adopt a binding code of ethics. The revelation of Thomas’s additional, unreported real estate deals with Crow further outraged Democrats and led to new calls for Thomas to step down.
Sen. Sheldon Whitehouse (D-R.I.) and Rep. Hank Johnson (D-Ga.) called on the Judicial Conference, the federal court system’s policymaking body, to refer Thomas to the U.S. attorney general for potential ethics violations. In addition to the justice’s unreported gifts and real estate deals, the lawmakers noted that Thomas admitted in 2011 he had failed to report $680,000 of his wife’s income from a conservative think tank...."
I'd say the chances of successfully referring Clarence Thomas for investigation depends solely on how badly the Progressives have screwed up the process by falsely going after Feinstein. This is on them.
